Court rejects lawsuit alleging condom found in jar of sauce

Abstract

AIDS: [Name removed]'s suit against Kroger Company was dismissed by a Federal judge in West Virginia. [Name removed] claimed that the spaghetti sauce she served her family, bottled by Kroger, contained a used condom. The condom was discovered during the dishwashing process, after the family had eaten dinner. [Name removed] and her family have been tested for HIV antibodies repeatedly and all tests have been negative. [Name removed] sued Kroger for negligent infliction of emotional distress. Tests conducted by the Food and Drug Administration (FDA) failed to show that the condom had been cooked and it could not be determined how the condom ended up in the family dishes.
