AIDS statement proves defendant intended to kill by biting

Abstract

AIDS: The Virginia Court of Appeals upheld a case in which a shoplifter who bit two retail employees after telling them he had AIDS was found guilty of malicious wounding. In [name removed] v. Commonwealth of Virginia, the court said that by declaring he had AIDS, [name removed] intended to maim, disfigure, disable or kill the employees that he bit during a scuffle following his apprehension for shoplifting. One judge dissented, saying that the biting may have only been an attempt to escape.
