Hawaii enacts new law to test sexual assailants

Abstract

AIDS: Hawaii has enacted a new law to enable victims of sexual assaults to obtain court orders that mandate HIV testing of the attackers. Senate Bill 1273 requires that victims are offered counseling and the right to have the attacker tested if found guilty of specific sexual offenses. This bill applies to juveniles and adults. The results can only be disclosed to the physician or HIV counselor that is designated by the victim. The law, now called Act 238, puts Hawaii in compliance with the Ryan White CARE Act Amendments of 1996, which require the testing of convicted sex offenders as a condition for receiving Federal aid.
