Abstract

KIE: In a case involving a patient who suffered paralysis following surgery to which he had formally but not knowledgeably consented, the Supreme Court of Canada ruled that the relationship between a surgeon and a patient gives rise to a duty of the surgeon to make disclosure of all material risks attending the recommended surgery. Even if a certain risk is a mere possibility, if its occurrence carries serious consequences, it should be regarded as a material risk requiring disclosure.
