Medical liability: the risk related to the new doctor-patient relationship. The practice of medecine, just as with any other profession, is being transformed by the development of new information technologies. But medicine is a one of a kind activity. In regards to the closeness established between physician and patient, the intimacy, the secrecy even. This closeness is necessary to the establishment of a trusting relationship, without whom there could be no traditional patient-doctor bonding. Yet, telemedicine brings the exact opposite: distance and dissemination. How can we then reconcile this distance with the imperatives brought by the doctor-patient relationship? within the protecting framework of any doctor's deontological rules? between the institution of secrecy, in total opposition with the information flow? As it appears, if these modern means of communication can, without a doubt, contribute to an increase in the quality of care, they are not without risks. Neither for the patient, nor the physician.
Responsabilité médicale : les risques liés aux nouvelles formes de la relation médecin-malade. La médecine n’échappe pas plus qu’aucune autre activité aux bouleversements induits par le développement des nouvelles technologies d’information. Mais ce n’est pas, précisément, une activité comme une autre. Par la proximité qu’elle suppose entre le soignant et le soigné, l’intimité, le secret même. Proximité qui est la condition de la confiance sans laquelle n’existe pas le fameux colloque singulier unissant le patient à son médecin. Or la télémédecine propose, au contraire exactement, l’éloignement et la diffusion. Comment alors concilier cet éloignement avec les impératifs traditionnels de la relation thérapeutique ? Avec le corpus protecteur des règles de la déontologie du médecin ? Avec l’institution du secret, tellement opposé à la culture du flux informatif ? Car si ces moyens modernes peuvent indiscutablement contribuer à l’amélioration de la qualité des soins, ils ne sont pas sans risque. Ni pour le patient ni pour le médecin.
