Clinical negligence and patient compensation

Abstract

This article reviews the aims and purposes of the tort system in clinical negligence and outlines the main criticisms of the way the system provides compensation to patients. Other methods of providing compensation that could better meet the needs of patients, while still ensuring professional accountability, are also discussed.
